Terms and Conditions

ORDERING

Minimum order is $30.00; orders placed for less than this amount will be subject to a $6.00 service charge. California residents add appropriate sales tax. Orders may be placed online; by mail; by calling our toll free customer service line (800) 321-5455 (Monday thru Friday, 9 a.m. to 4 p.m., Pacific Time) or by FAX (714) 821-1942. PRICING

Due to cost fluctuations by manufacturers, all prices are subject to change without notice. We are experiencing a number of pricing increases since many items are tied to the petroleum industry.

TERMS OF SALE

Customers without approved credit accounts will be required to pr-pay for ordered products using s business check, money order, cashiers check, or merchandise will be shipped C.O.D. We accept Visa or Mastercard for payment, subject to a 3% credit surcharge.

For approved credit accounts, terms are NET 30 days. Payments to account will be credited upon receipt by EMS Medical Products/Event Medical Services, Inc. A 1-1/2% finance charge will be assessed on overdue accounts. Accounts that are unpaid 45 days after date of invoice, will not be shipped additional merchandise until the account is returned to a "current" condition. Accounts more than 60 days overdue will be suspended and subject to credit review. Delinquent accounts will be referred for collection. Purchaser will be liable for all costs of collection, plus reasonable attorney's fees.

Open accounts will be extended to Government Agencies with terms of payment NET 30 days from date of shipment or invoice. Inquire about initial credit limit. Additional ordered merchandise will not be shipped if account is not in a "current" condition.

Credit limits are subject to review and adjustment, based on actual payments relative to our terms and product volume requirements.

Some products may require minimum purchasing volume.

SHIPPING

All orders are shipped pre-paid, F.O.B. from our Los Alamitos, CA. warehouse, unless otherwise specified. Special or "next day" shipping is available, upon customer request, with additional transportation charges included in the order. C.O.D. shipments are subject to additional collection fees.

Customers wishing to return merchandise must first obtain a RETURN AUTHORIZATION from our Customer Service Department, or you may contact us by e-mail. We will need the date and invoice number showing the merchandise involved. If merchandise is returned as a result of our error, it must be made within 10 days from date of shipment to be accepted without a restocking charge. If the return is not as a result of our error, there is a 25% restocking charge and merchandise must be returned within 15 days in a re-saleable condition, in order for us to issue a credit. Sterile goods or items purchased for resale may not be returned. If an order is lost in shipment, contact our Customer Service Department for instructions.

Most shipments are made by U.P.S. and require a street address for delivery. Large orders are sent by truck or economical freight.

PRODUCT LIABILITIES AND WARRANTIES

EMS Medical Products/Event Medical Services, Inc. gives no express or implied warranties on any items or merchandise offered for sale, shown in price lists or otherwise offered for sale and shall not be responsible for the proper use and servicing of goods purchased; nor does EMS Medical Products/Event Medical Services, Inc. give an express or implied warranty that goods purchased from it are merchantable or fit for a particular purpose other than those offered by individual manufacturers. EMS Medical Products/Event Medical Services, Inc. shall not be liable for special or consequential damages or injury to person or property which results from the use of these pre-hospital products. All products are intended for use by trained medical personnel. We do not manufacture any of the items shown for sale.

OXYGEN EQUIPMENT REPAIRS

EMS Medical Products/Event Medical Services, Inc. is a factory authorized Service Center for regulators, constant flow selectors, aspirators and resuscitators manufactured by Life Support Products (Allied Health Care) and Spirical Systems. FREE inspection and estimates are provided. Repaired devices by factory trained technicians to manufacturer specifications, carry a 90-day limited warranty. Loaner units are available if lengthy repair time is indicated.
